CONSENT TO ELECTRONIC PAYMENT ALERTS
Please read the following important information about receiving payment alerts electronically and retain a copy for your records. The words we, us, and our mean Sterling Jewelers Inc. d/b/a Kay Jewelers and Kay Jewelers Outlet. The word you means the individual or individuals with a Kay Jewelers and Kay Jewelers Outlet credit card account.
Consent to Receive Electronic Payment Alerts
By clicking the checkbox below, you certify that you consent to receive payment alerts in connection with your Kay Jewelers and Kay Jewelers Outlet credit card account electronically and have the ability to do so. We will send you a confirmation e-mail and/or text to the e-mail address and/or cell phone you have provided us. If you do not receive this confirmation e-mail and/or text within 72 hours, please contact us at 1-800-877-3616 to verify your information.
The number of e-mail and/or text payment alerts you will receive will depend on the number of alerts you elect and the number of credit accounts you register; however, you may only select and receive a maximum of two texts and two emails sent per month, per credit account. For text messages, you agree that we may send you text messages through your wireless provider. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless service provider. You agree to indemnify, defend, and hold us harmless from any third party claims, liability, damages, or costs arising from your use of the alerts or from you providing us with a phone number that is not your own.
Please allow up to three days for your enrollment to take effect. After your enrollment takes effect, you will receive payment alerts on the day or days that you selected. If you fail to make a required payment within five days after it is due, your payment alerts will be suspended until your account is brought current. We reserve the right to terminate this service or change terms of your use of this service at any time.
How to Update Your Records
It is your responsibility to provide and maintain a current e-mail address and/or cell phone number. You can update information under the "Manage Settings/Account Alerts" links, which are accessible by logging into your account at Kay.com or KayOutlet.com
You have the right to stop receiving payment alerts and may at any time withdraw your consent. You can withdraw your consent or update your e-mail address and/or cell phone number by clicking on the "Manage Settings/Account Alerts" links, by texting "STOP" in response to a payment alert, or by calling us at 1-800-877-3616.
If you request text message alerts and provide us with a cell phone number, you agree that we may contact you at this number for other purposes regarding your account and that all of our contacts with you may be made with an automated dialing and announcing or similar device and/or an artificial voice or prerecorded message. You understand that the payment alerts you have elected to receive contain confidential information about your account. You further understand that if you provide an e-mail address and/or cell phone number from your place of employment or an e-mail address and/or cell phone number that is shared with any third party this information will not remain confidential. We are not responsible for access by third parties to information and/or communications provided electronically nor any damages, including direct, indirect, special, incidental, or consequential damages caused by such access. We are not responsible for delays in the transmission of any information. You remain responsible for making all required payments on your account regardless of whether you receive or fail to receive an anticipated e-mail and/or text message alert. Regardless of what type of alert(s) you request, all of the terms of your Retail Installment Credit Agreement remain in place, including the provision regarding "How to Avoid Paying Interest on Your Account". We are not responsible for any computer virus or related problems. If your e-mail address and/or cell phone number changes, you are required to promptly notify us.
